1- What extraordinary action would you take?: Send in a support ticket; if that doesn't work, call them; if that doesn't work play CoD4 more.

Wouldn't that be pretty risky? If ANet doesn't settle you're going to have to show that the TOS is not a contract, and that you have the right to access ANets servers even if ANet doesn't want you to.
I'm not an attorney, but I'd buy a new key for $30 instead.
